Terms and Conditions

1. Eligibility

You hereby represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction), and that you have the right, power, and authority to agree to these Terms, to become a party to a legally binding agreement, and to perform your obligations hereunder.

2. Definitions

• “Payment Instrument” includes credit card, debit card, bank account, Unified Payment Interface (UPI), net banking, or any other method of payment supported through our payment processing partner, Razorpay, or any other payment processor we may use from time to time.
• “Platform” refers to the P3Kit website and application, where we offer AI-powered interview preparation products and services, and where a Transaction may be initiated.
• “Content” refers to any interview preparation kit, question, model answer, follow-up question, resume analysis, ATS compatibility report, suggested project, or other output generated by the Platform, whether automatically by artificial intelligence or otherwise.
• “Subscription” or “Plan” refers to the Free, Pro, Career, Unlimited, or any other paid or unpaid tier of access to the Platform that we may offer from time to time.
• “Transaction” refers to the order or request placed by the User with the Merchant to purchase a Subscription or other product and/or service listed on the Platform, by paying the Transaction Amount to the Merchant.
• “Transaction Amount” means the amount paid by the User in connection with a Transaction.
• “User” / “Users” means any person creating an account on, or availing the products and/or services offered on, the Platform.
• “Website” shall mean p3kit.arkionlabs.in, or any associated web or mobile application we operate.

3. Merchant’s Rights

You agree that we may collect, store, and process the information you provide — including your resume, target role and job description, and account details — in order to deliver the products and/or services you avail on our Platform, to generate Content on your behalf, and to contact you in relation to the same.

4. Your Responsibilities

You agree to provide us with true, complete, and up-to-date information about yourself as may be required to complete a Transaction or to generate Content, including but not limited to your name, email address, resume, target role, and accurate payment information required for a Transaction. You are solely responsible for the accuracy and completeness of any resume, job description, or other information you upload or provide, and for reviewing any Content generated from it before relying on it.

5. AI-Generated Content Disclaimer

The Platform uses artificial intelligence to generate interview questions, model answers, follow-up questions, resume and ATS compatibility analysis, suggested portfolio projects, and related Content based on the information you provide. You acknowledge and agree that:

• Content is generated automatically and may contain errors, omissions, or inaccuracies, including inaccurate assessments of your resume, skills, or experience.
• Content is provided for general interview preparation and educational purposes only, and does not constitute career, legal, financial, employment, or professional advice of any kind.
• We do not guarantee any specific outcome, including but not limited to interview performance, ATS system compatibility with any specific employer’s systems, shortlisting, or securing an offer of employment.
• You are solely responsible for reviewing, verifying, and using your own judgment regarding any Content before relying on it in an actual interview, job application, or professional context.
• We are not responsible for any decision made, or action taken, by any employer, recruiter, or third party based on your use of the Platform or Content.

6. Prohibited Actions

You may not access or use the Platform for any purpose other than that for which we make the Platform available. As a User of the Platform, you agree not to:

• Systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without our written permission.
• Make any unauthorized use of the Platform, including collecting the usernames and/or email addresses of other Users by electronic or other means, or creating accounts by automated means or under false pretenses.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform, including features that enforce limitations on the use of the Platform or Content, or that enforce Subscription-based usage limits.
• Trick, defraud, or mislead us or other Users, especially in any attempt to learn sensitive account information such as passwords.
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Engage in any automated use of the Platform, including scripts, bots, data mining, or similar data gathering or extraction tools.
• Interfere with, disrupt, or place an undue burden on the Platform or the networks or services connected to it.
• Attempt to impersonate another User or person.
• Use any information obtained from the Platform to harass, abuse, or harm another person.
• Use the Platform, or any Content generated by it, as part of any effort to compete with us, or for any revenue-generating endeavor or commercial enterprise not expressly authorized by us.
• Decipher, decompile, disassemble, or reverse engineer any software comprising or making up any part of the Platform.
• Attempt to bypass any measure designed to prevent or restrict access to the Platform or any portion of it.
• Harass, annoy, intimidate, or threaten any of our employees or agents.
• Copy or adapt the Platform’s software, including but not limited to any frontend or backend code, in whole or in part.
• Upload or transmit viruses, Trojan horses, or other malicious material, or otherwise interfere with the use, features, functions, operation, or maintenance of the Platform.
• Upload any resume, document, or other content that infringes the rights of any third party, or that you do not have the right to upload.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Platform.
• Use the Platform in a manner inconsistent with any applicable law or regulation.

7. Subscription, Billing & Cancellation

• The Platform offers a Free tier and one or more paid Subscription tiers, each with its own features and usage limits, as described on our Pricing page from time to time.
• Paid Subscriptions are billed on a recurring basis (e.g., monthly) through Razorpay, using your chosen Payment Instrument, unless otherwise stated at the time of purchase.
• Your Subscription will automatically renew at the end of each billing period at the then-current price, unless you cancel before the renewal date.
• You may cancel your Subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period; you will retain access to your paid Subscription’s features until that date, and no partial-period refund will be issued for the remaining time, except as required by applicable law or at our sole discretion.
• If a payment fails or is not renewed, your account may be downgraded to the Free tier, and access to paid features and previously generated Content may be limited accordingly, subject to the terms of our Refund and Cancellation Policy.
• Usage limits (including but not limited to the number of interview kits, ATS checks, or follow-up unlocks) reset on a periodic basis as described for your specific Plan, and unused allowances do not carry over between periods unless explicitly stated otherwise.
• All Transaction Amounts are quoted and charged in Indian Rupees (INR) unless otherwise specified.

8. Refunds

Cancellation and refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms by reference. Please review it for the circumstances in which a refund may be requested, the applicable refund window, and how refunds are decided and processed.

9. Data & Resume Privacy

Your resume and other personal information are processed in accordance with our separate Privacy Policy, which forms part of these Terms by reference. We take reasonable measures to protect your data, but you acknowledge that no method of electronic transmission or storage is completely secure. Please review our Privacy Policy for details on what we collect, how it is used, and your rights regarding your personal data.

10. Limitation of Liability

You agree that, in the event of a deficiency in the Platform’s products and/or services, your sole recourse is to initiate the refund process available under these Terms and our Refund and Cancellation Policy. We hereby expressly disclaim any further liability to you for any losses arising from such deficiency. You shall indemnify and hold harmless the Merchant and its affiliates, agents, and representatives from and against any and all claims, demands, causes of action, obligations, liabilities, losses, damages, injuries, costs, and expenses incurred or sustained by reason of or arising out of any breach or alleged breach of these Terms by you.

To the maximum extent permitted by applicable law, our aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Governing Law & Dispute Resolution

These Terms, their subject matter, and their formation, are governed by the laws of India. You and we both agree that the courts of India shall have exclusive jurisdiction over any dispute.

Any dispute or claim arising out of or in connection with these Terms, or their breach, termination, or invalidity (a “Dispute”), shall be referred to and finally resolved by arbitration in Bengaluru in accordance with the Arbitration and Conciliation Act, 1996, as in force from time to time, the provisions of which are deemed incorporated by reference into this clause. Within thirty (30) days of the issuance of a notice of Dispute, the parties shall mutually agree on the appointment of a sole arbitrator; failing such agreement within that period, the sole arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bengaluru, India, and proceedings shall be conducted in the English language. The parties shall keep the arbitration confidential, except as required by law. The arbitrator’s decision shall be final and binding on both parties. Nothing in this clause shall preclude either party from seeking suitable injunctive relief in appropriate circumstances from courts in Bengaluru. Each party shall bear its own costs of arbitration, subject to reallocation as directed in the arbitral award.

12. Grievance Redressal

If you have any question or complaint regarding any product and/or service availed on our Platform, or pertaining to a Transaction — including but not limited to double debit of a Transaction Amount, a fraudulent or unauthorized Transaction, or a refund request — you may reach us at contact@arkionlabs.in.

13. Disclaimer

Upon initiating a Transaction, you, as a User, are entering into a legally binding and enforceable contract with us to purchase the relevant Subscription and/or Content, and agree to pay the price listed on the Platform through legitimate and legal sources of funds and accepted Payment Instruments. You shall provide accurate payment details to our payment processor, Razorpay, for the purposes of completing your purchase.

Information you provide may be shared with a third party where required for fraud verification, or by law, regulation, or court order. We expressly disclaim all liability arising from any unauthorized use of your Payment Instrument. All payments are undertaken at your own risk; we shall not be liable for any loss or damage arising directly or indirectly from a decline of authorization, malfunction, error, or unscrupulous activity related to a Transaction.

If you receive a user identification code, password, or any other information as part of our security procedures, you must treat it as confidential and must not disclose it to any third party.

The Content on this Platform, including all AI-generated interview preparation material, is provided for general informational and educational purposes only. It does not amount to advice from us in any manner and should not be solely relied upon; see the AI-Generated Content Disclaimer above. Where our Platform contains links to other websites or resources provided by third parties, these links are provided for your information only, and should not be interpreted as our endorsement of those websites or any information you may obtain from them. We do not guarantee that the Platform will be secure or free from bugs, errors, or interruptions. You are responsible for configuring your own information technology, device, and software to access the Platform, and for using your own virus protection software.
